What were talking about here are parents and sometimes grandparents.

SCOTUS has struck down state laws that would stop nursing and Board and Care homes from using forced arbitration. This means no matter what, if a nursing home is responsible for injury and/or death to a resident, there is no recourse to the courts, any claim must be brought in binding arbitration. FYI, this isn't really "arbitration," since that term is legally defined as ". . . the use of an arbitrator to settle a dispute." Arbitrators are used to get the parties to settle on agreed terms.

In my decades in California, I had experience with both Nursing homes and B&C facilities, and arbitration. If you want to know what is too often the case, and I observed some of it first hand, just Google "Nursing home horror stories."

Also, read the facts and stats on how many claimants win in binding arbitration, and how in most cases, the arbitrators are anything but neutral.

So if you are or think/feel you may ever be in the position of having to put a loved one in a nursing or Board and Care facility, please read all about this ruling.

From what I have observed here, albeit limited, the Board and Care hones are very well run by decent staffs.It's true, there is no accountability here (Mexico) is lonesome. including a doctor, screws up, with this SCOTUS ruling, as a realistic matter, there is no accountability in nursing/Board and Care hones. Also, 99% of these facilities used forced arbitration, and with doctors, it looks to be 99.999%.

Sounds like they should do the same thing to the entire medical community in the US. Isn't the astronomically high medical costs in the US partially due to the litigious culture there?

I speak from a knowledge of the law in this area.

No! it is not litigation that haa driven up the costs of medical care, it's 98.6% greed, plus the fact, that second only to food, medical care is a necessity of life.

Realistically, forced arbitration leaves most people with very little to no recourse. You can verify this by following the links in the original story and look at the stats.

Just as with food, medical costs will continue to rise so long as people will/can pay them.

Show me a "Poor" doctor, and I'll show you one who works with "Doctors Without Borders," VISTA, and free clinics near full time.

The above are not my opinions, but the result of my in-depth research on the subject for many years.

Cost of malpractice insurance is one, but note how many states can damagesfor some areas of malpractice.

The costs of MMPI (Medical MalPractice Insurance) vary from state to state and from what kind of doctors (or hospitals) you are looking at.

Realistically, insurance companies are NOT non-profit, and if you think (or thought) MMPI would go down when states put some very severe caps on some MMP awards, think again.

Usually, before I say something, I research it across the board. I love researching and learning. I believe for myself, it's what you learn after you think you know it all that counts, and I have never thought I knew near all. Always more to learn because things often change.

I don't get your logic how shutting down the ambulance chasers and predatory care facilities is going to cause an exodus to Mexico. What is in place here to protect the elderly and mistreated?

It's also interesting that a lawyer wouldn't want to assign any blame for medical costs to the litigious nature of the U.S.

I'd like to hear the process by which he concludes that seniors in U.S. care facilities who are forced into using arbitration to resolve disputes would choose to come to Mexico where there are no additional choices as far as I know.

You are correct; I was not at all clear or complete.

My thinking was and is that since with forced arbitration, that the quality of care here may be better, at least that's what I concluded my mini-research project.

Now that there is forced arbitration NOB in many states, I believe the quality of care may drop (further) NOB because as I said, most people can't afford forced arbitration and the odds are stacked against the entailment. .

I have personally seen too much incompetency in these facility to not know there are major problems. And as said, just Google it.

IMO of course.
